1st Degree Felony.
A defendant commits object rape of a child (domestic violence) when they cause the penetration or touching, however slight, of the genital or anal opening of a child who is under the age of 14 by any foreign object, substance, instrument, or device, not including a part of the human body, with intent to cause substantial emotional or bodily pain to the child or with the intent to arouse or gratify the sexual desire of any person.
Not less than 25 years and which may be for life.
15 years and which may be for life, if the judge finds that during the course of the commission of the object rape the defendant caused serious bodily injury to another; or that at the time of the commission of the object rape of a child the defendant was previously convicted of a grievous sexual offense.
1st degree felony: A fine not to exceed $10,000, plus a 90% surcharge.

Because of the unique and highly emotional nature of domestic violence crimes, the high recidivism
rate of violent offenders, and the demonstrated increased risk of continued acts of violence subsequent
to the release of an offender who has been arrested for domestic violence, it was the finding of the
Utah Legislature that domestic violence crimes, are crimes for which bail may be denied if there is
substantial evidence to support the charge, and if the court finds by clear and convincing evidence
that he alleged perpetrator would constitute a substantial danger to an alleged victim of domestic
violence if released on bail.
