Depending on the facts, arson (domestic violence) can be charged as a 2nd degree felony, 3rd degree felony, class A misdemeanor or class B misdemeanor.
A defendant commits a 2nd degree felony arson (domestic violence) when under circumstances not amounting to aggravated arson (domestic violence), the defendant by means of fire or explosives unlawfully and intentionally damages any property with the intention of defrauding an insurer.
A defendant also commits a 2nd degree felony arson (domestic violence) when under circumstances not amounting to aggravated arson (domestic violence), the defendant by means of fire or explosives unlawfully and intentionally damages the property of another and the damage caused is or exceeds $5,000 in value; or as a proximate result of the fire or explosion, any person not a participant n the offense suffers serious bodily injury.
A defendant commits a 3rd degree felony arson (domestic violence) when under circumstances not amounting to aggravated arson (domestic violence), the defendant by means of fire or explosives unlawfully and intentionally damages the property of another and the damage caused is or exceeds $1,500 but is less than $5,000 in value; as a proximate result of the fire or explosion, any person not a participant in the offense suffers substantial bodily injury; or the fire or explosion endangers human life.
A defendant commits a class A misdemeanor arson (domestic violence) when under circumstances not amounting to aggravated arson (domestic violence), the defendant by means of fire or explosives unlawfully and intentionally damages the property of another and the damage caused is or exceeds $500 but is less than $1,500 in value.
A defendant commits a class B misdemeanor arson (domestic violence) when under circumstances not amounting to aggravated arson (domestic violence), the defendant by means of fire or explosives unlawfully and intentionally damages the property of another and the damage caused is less than $500.
Class B misdemeanor: A fine not to exceed $1,000, plus a 90% surcharge.

The court may order the accused to pay restitution if convicted of this crime.

Because of the unique and highly emotional nature of domestic violence crimes, the high recidivism
rate of violent offenders, and the demonstrated increased risk of continued acts of violence subsequent
to the release of an offender who has been arrested for domestic violence, it was the finding of the
Utah Legislature that domestic violence crimes, are crimes for which bail may be denied if there is
substantial evidence to support the charge, and if the court finds by clear and convincing evidence
that he alleged perpetrator would constitute a substantial danger to an alleged victim of domestic
violence if released on bail.

A defendant convicted of a class A misdemeanor, 2nd degree felony or 3rd degree felony arson (domestic violence) must provide a DNA specimen.

A defendant convicted of arson (domestic violence) may not posses, use or have control of a firearm or ammunition for life.
